CCMA DETERMINATION REGARDING PICKETING RULES FAVOURS MASSDISCOUNTERS

The Commission for Conciliation, Mediation and Arbitration (CCMA) today ruled in favour of Massdiscounters (Game and Dion) in an application brought by SACCAWU regarding picketing rights inside the company’s stores.
This follows attempted illegal action by SACCAWU members to disrupt trade at five Game stores in Gauteng earlier this week.
In terms of the rule, picketing employees may not come within 50 metres of the entrance of any Massdiscounters (Game and Dion) standalone store, or where the store doubles up as the entrance to the shopping centre or mall.
Where stores are situated within a shopping centre or mall then the picketing may not occur within 50 metres of the mall entrance.
The 50 metre rule also applies in respect of any adjacent or nearby business.
